Abstraksi
Reflective critical crystallization based on philosophy of Pancasila (five basic principles of the Republic of Indonesia) ontologically affirms that spirit of Pancasila is a family based and spirited by love and affection. It comes up from love and affection from God the all mighty. As we implement Pancasila as a normative principle of national law, and as the source of all law sources, so law and its purposes should be a family and protect all Indonesian people. It means that application of dead penalty in the law of Pancasila automatically is against the principle of family acknowledging and respecting human value and dignity, including acknowledgement and respectability to “the sanctity of life”. Based on the above deductive argument arranged on the basis of systematic- problematic thought model based on premises which have existed concerning philosophy of Pancasila study, and national legal system. The conclusion is; the dead penalty is absolutely not justified as it cannot be accounted for.
