Doktor Ilmu Hukum (S3) dari Program Pascasarjana UNPAR tahun 2003.   Abstraksi     There is opinion or assumption in the press society that the National Penal Code Draft prepared by the Government still remains professes paradigm of journalistic work criminalization as it is provided in the Penal Code. The Penal Code Draft is regarded as a means of judging the press. So far Indonesia has already published the Act No. 44 year of 1999, but in fact, those regulations are seldom used and applied by judges in giving decision involving the press. The position of this Act is threatened because of the press freedom criminalization in the Penal Code Draft. To make this Act exist and has position as lex specialis, amendment should be performed to avoid a prolonged complicated polemic and get certainty of law by accommodating provisions about press crime which has been regulated in the Penal Code or regulated in the new Penal Code by involving discussion about press in the legislation process between press society and legislator so that press freedom criminalization in the general legislation such as Penal Code will not happen any more.   Download Attachment
